The trial and sentence of five Cuban antiterrorists in the United States brought to light a criminal event "full of irregularities and violations of the due process of law," Panamanian lawyer Ramiro Guerra asserted on Monday.
In a think piece entitled "Constitutional grace as an instrument of justice", the specialist analyzed the case of Gerardo Hernández, Rene González, Ramón Labañino, Antonio Guerrero and Fernando González from the point of view of law.
According to Guerra, "the charges of terrorism attributed to them were never proved” by the prosecution.Instead, added the jurist, "it became clear that they acted driven by a sense or cause of need, since they were seeking information to prevent the actions of anti-Cuban associations against their country."
A recent forum of experts offered a detailed assessment of the trial and the sentences against these Cubans from a criminal, procedural and human perspective.
As a result of that meeting, said Guerra, the violations of the United Nations International Covenant on Civil and Political Rights and of the Standard Minimum Rules for the Treatment of Prisoners on the rights of detainees to have regular contacts with their families and friends were also demonstrated.
The context described, he pointed out, is the one serving U.S. President Barack Obama, with a view to send a message of humanity and justice and make use of his constitutional power to pardon The Five, thus allowing their encounter with their loved ones.
