On November 10, Law-Decree 288 and several additional ministerial resolutions will come into force in Cuba in order to eliminate a series of prohibitions and streamline procedures related to homeownership.
Published on issue 35 of the Official Gazette on November 2, 2011, the new regulations change Chapter 5 of the Housing General Law, thusly fulfilling Guideline 297 of the document approved at the Sixth Congress of the Communist Party of Cuba. It establishes the purchase/sale of properties and relaxes other forms of procedures related to ownership and title transfer, among others.
The new regulations include the purchase, sale, donation, and exchange of houses among Cubans living in Cuba or foreigners living in the country.
Authorizations previously granted by the Housing Municipal Board have been eliminated. All titles are required to be registered at the National Title Registration Office.
The new law ratifies that people have the right to own only one house as their permanent residence, and another one in the beach or the country.
The legalization of the procedures related to ownership will be carried out before a notary public in the municipality where the property is located, and the applicable taxes should be paid.
